ON DIGNITY, VULNERABILITY, INDIGENOUS PEOPLES AND FISHERFOLKS: CHILEAN SUBSISTENCE FISHING ACCORDING TO INTERNATIONAL HUMAN RIGHTS

Abstract Subsistence fishing is a confusing and heterogeneous fishery construct. Even so, its connection to human protection compels us analyze it through the lens of rights. Using case Chile due legal peculiarities, we aim determine scope Chilean legislation on subsistence fishing, integrating international treaties rights, law, reports from United Nations agencies regarding three issues. First, examine how relates right food promotion decent social conditions. Next, explain why prohibition riggings propulsion enables identify economically precarious users this related vulnerabilities poverty as rights concepts. Finally, show property indigenous peoples culture fisherfolk populations could impose their inclusion preferences in access resources. Considering results, hold that help clarify understanding propose partial amendments fishing. But, above all, they introduce standards allow see such not mere derivation state privilege, but an attempt foster situation equality: affirmative action. We conclude by presenting conceptual approach for suggesting unveil new objectives even influence natural resource allocation.
